Compliant HSA/FSA Messaging

Use this guide whenever you write or review customer-facing copy that mentions HSA/FSA or Truemed: ads, emails, product pages, banners, social posts. Check your draft against the eight rules, grab approved language from the copy bank, and add the disclaimer. This page is the source of truth for HSA/FSA messaging; if copy anywhere conflicts with it, this page wins.

The Eight Rules

Check every asset against these before it goes live.

  1. Eligibility is conditional. Use “may be eligible,” “if you qualify,” “with a Truemed LMN.” Never “guaranteed,” “approved,” or “is eligible” stated flatly.
  2. Scope claims to specific products. No brand-wide or category-wide claims unless nearly all of your products qualify.
  3. Savings are always “an average of 30%*” with the disclaimer. Never “up to,” never “save 30% now!”, never a percentage without the disclaimer.
  4. Use the right words. Practitioner, not doctor. Health survey, not quick survey. Letter of Medical Necessity (LMN), not doctor’s note. See the terminology table below.
  5. Tie benefits to health conditions, not wellness. “Manage chronic health conditions like diabetes, obesity, and hypertension,” not “feel energized” or “look radiant.”
  6. Truemed isn’t free. The cost of Truemed’s services is included in the purchase price. Never “free” or “we cover the cost.”
  7. Don’t speak for third parties. Never predict what a practitioner will decide or what an HSA/FSA plan will reimburse.
  8. Add the disclaimer. Every eligibility or savings claim carries the disclaimer, in the copy itself or on the creative. See The Disclaimer for the exact wording and placement rules.

The Disclaimer

One disclaimer covers every eligibility and savings claim. Use it verbatim:

Truemed is for qualified customers. HSA/FSA tax savings vary. Learn more at truemed.com/disclosures.

Placement:

  • Same screen or creative as the claim. If space is tight, use an asterisk (*) pointing to a visible footer.
  • Readable: not tiny, strong contrast. In video, visible for at least 3 to 4 seconds.
  • In text, hyperlink truemed.com/disclosures. In images or video, the URL text alone is fine.
  • Tight on space? A [Brand logo] + [Truemed logo] lockup with the disclaimer beneath it works.

Two notes: clinicians are independent, so never “our” clinicians. Accurate modifiers are fine (“seamless health survey” works; “quick survey” doesn’t).

Eligibility: Product vs. Brand Claims

Keep claims narrow. A brand-wide claim misrepresents eligibility whenever your catalog includes both eligible and ineligible items. Mention the LMN where you can; eligibility generally requires one.

Product-level (preferred for mixed catalogs):

  • HSA/FSA eligible with a Truemed LMN.
  • This item may be HSA/FSA-eligible when used to address a specific health condition.

Mixed category page:

  • Some products may qualify for HSA/FSA with a Truemed LMN. Look for the Truemed logo on product pages.

Exception, only if all or nearly all of your products are eligible:

  • Our products are HSA/FSA eligible with a letter of medical necessity.
  • [Brand] now accepts HSA/FSA for qualified customers.

Never say (for mixed catalogs):

  • [Brand] is HSA/FSA approved.
  • Use your HSA/FSA on our entire [Category].
  • Use your HSA/FSA dollars. (implies everyone qualifies)
  • Your purchase is now HSA/FSA eligible with Truemed.

“HSA/FSA funds now accepted” always needs a qualifier such as “for qualified customers.”

Savings Claims

The approved claim is that customers save an average of 30% by using pre-tax HSA/FSA funds. Your copy describes what the average customer saves; it must never read as a promise to each individual reader.

Approved patterns:

  • 30%* savings on average when you pay with HSA/FSA funds.
  • Truemed makes it simple for qualified customers to pay with HSA/FSA funds and save an average of 30%*.
  • Eligible customers save an average of 30% on top of [Sale] deals*.

Prohibited:

  • Save up to 40%.
  • Save 30% now!
  • Any percentage without the disclaimer.

FAQs

Can we say “[Brand] is HSA/FSA eligible”? Not if you sell a mix of eligible and ineligible products. Use product-specific claims or “some products may qualify.” The exception: if all or nearly all of your products qualify, broader claims are fine.

Can we say how fast or how likely approval is? Never state or imply the odds of approval. Only use a specific turnaround claim (like “most customers hear back within 24 hours”) if Truemed has confirmed it’s substantiated.

The claim is tiny. Do we still need the disclaimer? Yes. Use proximity or an asterisk to a visible footer.

Can we say FSA funds expire December 31? Hedge it: “for most plans, FSA funds expire December 31.” Deadlines vary by plan, so never state a universal expiration date.

How do we describe the clinician review? An independent licensed practitioner will review your clinical intake form.
